These Terms of Service ("Terms") govern your use of the website exclusivetrnds.com (the "Site") and any purchases you make from us. By accessing the Site or placing an order, you agree to be bound by these Terms. Please read them carefully before making a purchase.

TRNDS LTD is a UK-registered independent retailer specialising in authentic footwear, streetwear, apparel, and collectables. We are not owned by, affiliated with, or authorised by any of the brands we sell. All brand names, logos, and trademarks are the property of their respective owners. Products are sourced from authorised distributors, licensed wholesalers, and verified retail channels.

Our Site is hosted on Shopify Inc., which provides us with the e-commerce platform to sell our products and services to you.

1. ELIGIBILITY

By placing an order on our Site, you confirm that you are at least 16 years of age (or have parental/guardian consent) and that the information you provide is accurate and complete. If you are purchasing on behalf of a business, you confirm that you have authority to bind that business to these Terms.

2. PRODUCTS AND PRICING

All products listed on the Site are subject to availability. We make every effort to ensure that product descriptions, images, and pricing are accurate. However, errors may occur. If we discover an error in the price of a product you have ordered, we will contact you before dispatching the order to confirm whether you wish to proceed at the correct price or cancel.

All prices are displayed in GBP (£) and include VAT where applicable. Prices may change at any time without notice, but changes will not affect orders that have already been confirmed.

As an independent retailer, our prices reflect the current market value of each product. Prices may differ from the original retail price set by the brand. Where a product is listed above or below the original retail price, this reflects supply, demand, and availability at the time of listing.

3. ORDERS AND PAYMENT

When you place an order, you are making an offer to purchase the products in your basket. We will send you an order confirmation email acknowledging receipt of your order. A binding contract between you and TRNDS LTD is formed only when we dispatch your order and send you a dispatch confirmation email.

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity. If we cancel your order after payment has been taken, we will issue a full refund.

Payment methods:

We accept payment via Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay, Shop Pay, and Klarna (Buy Now, Pay Later). All payments are processed securely through PCI-DSS compliant payment providers. We do not store your card details. Credit card information is always encrypted during transfer over networks.

Klarna:

4. SHIPPING AND DELIVERY

We offer shipping within the United Kingdom and internationally. Delivery times and costs vary depending on the shipping method selected at checkout and your delivery location. Estimated delivery times are provided at checkout and in your confirmation email, but are not guaranteed.

Risk of loss and title for items purchased pass to you upon delivery to the carrier. If your order is lost or damaged in transit, please contact us within 14 days of the expected delivery date so we can investigate and resolve the issue.

5. RETURNS AND REFUNDS

Your statutory rights:

Under the Consumer Rights Act 2015, you have the right to return goods that are faulty, not as described, or not fit for purpose. These statutory rights are not affected by anything in these Terms. If a product is faulty or not as described, we will offer a full refund, replacement, or repair at our discretion.

Right to cancel (distance selling):

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods without giving any reason. To exercise this right, you must notify us in writing (by email to contact@exclusivetrnds.com) within the 14-day cancellation period.

You must return the goods to us within 14 days of notifying us of the cancellation. Products must be returned in their original condition, unworn, with all original tags and packaging intact. You are responsible for the cost of return shipping unless the product is faulty or not as described.

Once we receive and inspect the returned item, we will process your refund within 14 days. Refunds will be issued to the original payment method.

Non-returnable items:

The following items cannot be returned unless faulty or not as described:

- Sale items, electronic items, watches, and items obtained through sourcing requests (final sale)
- Sealed collectables (trading card products, booster boxes, tins) that have been opened or had their factory seal broken
- Items that have been worn, washed, altered, or damaged after delivery
- Gift cards

6. PRODUCT AUTHENTICITY

Every product sold on our Site is 100% authentic. We source all products from authorised distributors, licensed wholesalers, and verified retail channels. Each item is inspected and quality-checked before dispatch. We do not sell counterfeit, replica, or imitation goods.

If you believe a product you have received is not authentic, contact us within 14 days of delivery at contact@exclusivetrnds.com. We will investigate and, if necessary, offer a full refund or exchange.

7. INTELLECTUAL PROPERTY

All content on the Site, including text, images, graphics, logos, page layouts, and software, is the property of TRNDS LTD or its content suppliers and is protected by UK and international copyright, trademark, and intellectual property laws.

Third-party brand names, logos, and trademarks displayed on the Site are the property of their respective owners and are used solely for the purpose of identifying the products we sell. Their use does not imply any affiliation with, endorsement by, or authorisation from those brand owners.

You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

8. USE OF THE SITE

You agree to use the Site only for lawful purposes. You must not:

- Use the Site in any way that breaches applicable law or regulation
- Use the Site to transmit unsolicited or unauthorised advertising or promotional material
- Attempt to gain unauthorised access to our systems, servers, or databases

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

Subject to the above, our total liability to you in connection with any order shall not exceed the total amount you paid for that order. We are not liable for any indirect, incidental, special, or consequential losses arising from your use of the Site or any products purchased from us, including but not limited to loss of profit, loss of data, or loss of goodwill.

We do not guarantee that the Site will be available at all times or free from errors, viruses, or other harmful components. We are not liable for any loss or damage caused by viruses or other technologically harmful material that may infect your equipment.

11. FORCE MAJEURE

We shall not be liable for any delay or failure to perform our obligations where the delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, government actions, postal or courier delays, supplier failures, or disruptions to telecommunications or internet services.

12. THIRD-PARTY LINKS

Our Site may contain links to third-party websites. These links are provided for your convenience only. We have no control over and accept no responsibility for the content, privacy practices, or availability of third-party websites.

13. TRADE SANCTIONS COMPLIANCE

Our products and services are not available to individuals or entities restricted under applicable trade sanctions and regulations. By accessing our Site or purchasing our products, you represent that you are not subject to any sanctions or trade restrictions imposed by your jurisdiction or international authorities.

16. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer under applicable consumer protection legislation.

If you are unhappy with a purchase or have a dispute that we have been unable to resolve, you may also refer the matter to an Alternative Dispute Resolution (ADR) provider.
